Restatement of bad debts

Do your provisions for In Bonis debtors still have value?

2R CONSEIL, from experience answers : YES for some

Your 416 account is burdened each year with new provisions following an unresolved dispute, a creditor who does not respond to any reminders, a lack of contractual documents or the disappearance of your debtor.

You provide us with the copy of the invoices concerned as well as all the contractual documents that you have and we immediately contact your debtor to find an amicable or legal solution if possible.

Several possible cases

  • Your debtor pays us thus generating collection fees
  • Your debtor raises a dispute that can be partially or totally resolved
  • We succeed in finding the trace of your debtor (invoicing in addition)
  • All the documents provided could allow legal treatment. We will question you before so that you mark your agreement
  • You have an enforceable title and we take over the forced execution
  • Your debtor is insolvent and we issue you a reasoned certificate for either the recovery of the VAT or the passage and definitive loss

What are the limitation periods in commercial and civil matters?

For an invoice that remains unpaid, you have a period of 2 years to take legal action and recover your invoices when the debtor is a consumer. On the other hand, this period is 5 years when the debtor is a professional, a commercial company or a merchant.
